VOLUNTEER CONFIDENTIALY POLICY

Respecting the privacy of clients, donors, members, staff, and volunteers is a basic value of ReEstablish Richmond. Personal and financial information is confidential and should not be disclosed or discussed with anyone without permission or authorization from the Executive Director. Care shall always be taken to ensure that unauthorized individuals do not overhear any discussion of confidential information and that documents containing confidential information are not left in the open or inadvertently shared. Employees, volunteers, and board members of ReEstablish Richmond may be exposed to information which is confidential and/or privileged and proprietary in nature. It is the policy of ReEstablish Richmond that such information must be kept confidential both during and after employment or volunteer service. Staff and volunteers, including board members, are expected to return materials containing privileged or confidential information at the time of separation from employment or expiration of service. Unauthorized disclosure of confidential or privileged information is a serious violation of this policy and will subject the person(s) who made the unauthorized disclosure to appropriate discipline, including removal/dismissal.  

Acknowledgement of Confidentiality of Client Information: As a volunteer with ReEstablish Richmond, I agree to treat as confidential all information about clients or former clients and their families that I learn during the performance of my duties as volunteer, and I understand that it would be a violation of policy to disclose such information to anyone without checking first with ReEstablish Richmond staff and receiving written permission from the client(s).  

VOLUNTEER WAIVER AND LIABILITY RELEASE FORM

No Compensation or Benefits: I understand that as a volunteer, I am not a ReEstablish Richmond employee or agent and will not represent myself as such nor will I claim the status or benefits of a ReEstablish Richmond employee. Furthermore, I understand that I am not eligible for coverage or to receive any benefit under any ReEstablish Richmond employee benefit plan, insurance plan, or compensation arrangement. I also understand that I am not entitled to receive workers’ compensation benefits or unemployment insurance benefits after ending my role as a volunteer with ReEstablish Richmond. I agree to maintain my own health insurance and, if I drive as a volunteer or my vehicle is used in the course of or as a component of volunteering for ReEstablish Richmond, my own auto liability insurance, during my time as a volunteer.

Illness Liability Statement: I understand that I may be volunteering in close proximity and in personal spaces of ReEstablish Richmond clients. If you are experiencing symptoms indicating illness, please take necessary precautions and stay home if necessary. As a volunteer, I hereby expressly assume risk of injury or harm from these activities and release ReEstablish Richmond from all liability.

Associated Risks: I understand that my participation as a volunteer presents a risk of property damage, including, without limitation, the following (not all of these may apply): damage to personal vehicles, personal property, and personal effects, and a risk of bodily injury or death at or in any location or vehicle at or in which I may function as a volunteer (each, a “Premises”), including, without limitation, those resulting from the failure to warn of dangerous conditions in connection with my role as a volunteer, my travel to and from and my participation in any ReEstablish Richmond related event, activity, training, and specifically motor vehicle driver training, and/or my use of any Premises, and/or the acts or omissions of ReEstablish Richmond or any other participant or volunteer in any ReEstablish Richmond related activities or meetings or operating or occupying any such Premises. As a volunteer, I hereby expressly assume risk of injury or harm from these activities and release ReEstablish Richmond from all liability.

Waiver, Release, Hold Harmless, and Indemnification: I, on behalf of myself and successors in interests, to the fullest extent permitted by law, hereby irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue ReEstablish Richmond, its successors, assigns and affiliated entities, and each of the foregoing’s respective directors, officers, board members, employees, representatives, independent contractors, insurers, attorneys and/or agents (the “Released Parties") from any and all claims, demands, rights, actions, suits, causes of action, attorneys’ fees, damages, etc. of whatever kind whether known or unknown related to or arising, directly or indirectly, from my participation as a volunteer, my travel to and from ReEstablish Richmond related activities or meetings, my entry onto or use of any Premises, and any volunteer services I provide for or to ReEstablish Richmond or occurring while I am providing volunteer services for ReEstablish Richmond. I further agree that I will defend, hold harmless, and indemnify ReEstablish Richmond, and the “Released Parties” and volunteers from and against all claims, causes of actions, accusations, notices, judgments, rulings, liabilities, expenses, etc., including reasonable attorney’s fees that may exist as a result of my actions, inactions, negligence, errors, acts, or omissions. I understand and agree that if any claim is brought against me arising, in any way, from my travel to and from any ReEstablish Richmond related activities or meetings and/or my participation as a ReEstablish Richmond volunteer, I shall not be entitled to a defense or indemnification by ReEstablish Richmond in connection with such claim, unless such defense or indemnification is expressly required by law.

Insurance: Further, I understand that ReEstablish Richmond does not assume any responsibility for or obligation to provide me with financial or other assistance, including but not limited to medical, health, or disability benefits or insurance. I expressly waive any such claim for compensation or liability on the part of ReEstablish Richmond beyond what may be offered freely by ReEstablish Richmond in the event of injury or medical expenses incurred by me.

Medical Treatment and Pre-existing Conditions: I do hereby release and forever discharge ReEstablish Richmond from any claim whatsoever that arises or may hereafter 2 arise on account of any first aid treatment, or other medical services rendered in connection with my services to ReEstablish Richmond. I further certify that I have informed ReEstablish Richmond and any person coordinating my volunteer services of any relevant pre-existing health problems, insect, food or medication allergies and will provide for myself any appropriate medication to treat these health problems. In relation to the above certification of pre-existing medical conditions, I do hereby also release and forever discharge ReEstablish Richmond from any claim whatsoever that arises from any complication of or exacerbation of any pre-existing medical conditions.

Other: As a volunteer, I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Commonwealth of Virginia and that this Release shall be governed by and interpreted in accordance with the laws of the Commonwealth of Virginia. This Release shall be binding and enforceable against me, my successors, assignees, heirs, guardians and legal representatives. I agree that in the event that any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.

I have read and fully understand the above waiver: I understand that by agreeing to this document I am giving up certain rights and accepting certain legal duties, and that this Agreement shall remain in full force and effect at all times while I am participating in any activities with, for, or on behalf of ReEstablish Richmond.

VOLUNTEER MEDIA WAIVER

ReEstablish Richmond would like to confirm permission to use my likeness in photographs, video recordings, or electronic images in addition to any written reflections of my experience with ReEstablish Richmond. These images and entries may appear in any and all of its publications, including website entries, social media, and publications without payment or any other consideration. I understand and agree that these materials will become the property of the organization and will not be returned. I hereby irrevocably authorize the organization to edit, alter, copy, exhibit, publish or distribute these images for purposes of publicizing the organization's programs or for any other lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image. I hereby hold harmless and release and forever discharge the organization from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
